What the ACP-5 actually says
It is a report by a DEP-certified investigator confirming your work will not disturb asbestos-containing material, or that what is there is below the DEP threshold of ten square feet or twenty-five linear feet of friable material and will not be disturbed. It is required for renovation, alteration or demolition in a building put up before 1 April 1987 where the work needs a DOB permit, and DOB will not release that permit until it is on file. On a full demolition it also has to be in before sign-off. If material is found above threshold, the answer is abatement first, not a different report.
How asbestos and hazardous material runs
The order matters more than the tools. This is the sequence for asbestos and hazardous material.
Establish the building age
Before 1 April 1987 and needing a DOB permit means an assessment is required. That one date decides whether your project has an extra step on its critical path, so it is the first thing we check.
Instruct the investigator
A DEP-certified asbestos investigator surveys the specific scope of work. We arrange it and brief them on exactly what is coming out, because the report covers the described work rather than the building in general.
The ACP-5 is filed and verified
Filed with DEP, verified by DOB. Until it clears, the construction permit does not issue — which is why this runs first and not alongside the drawings.
Positive above threshold goes to abatement
Licensed abatement runs ahead of demolition under its own permit. We hold the programme around that window rather than letting the two trades collide.
Then the demolition starts
With clearance in hand, the strip-out or take-down proceeds, and any lead-painted or otherwise contaminated material is kept out of the C&D stream on the way out.

Asbestos and hazardous material: your questions
What about lead paint?
Coatings applied before 1978 may contain lead, which puts them in the same category as asbestos for disposal: lead-contaminated material is not construction and demolition debris and cannot travel in a C&D load. On a strip-out we treat pre-1978 painted surfaces as suspect, keep that material out of the general stream and route it separately. Where a job would disturb lead paint at scale, that work is separately regulated, and we arrange the certified specialist and sequence that work ahead of ours the same way we do with asbestos.
My building is from 1985. Do I definitely need this?
If the work needs a DOB permit, yes. The line is 1 April 1987 and it applies to the building, not to the room you are working in. Most New York housing stock sits on the wrong side of that line.
Can you just take the tile up and see?
No. Disturbing suspect material to identify it is the thing the rule exists to prevent. It gets assessed by a certified investigator first, and that is not a step we will work around.
What if the report comes back positive?
The job goes to licensed abatement before demolition can proceed. That changes the programme and the cost, and it is far better to know at week one than at week six.
Who does the abatement if the report is positive?
Licensed abatement is its own permitted trade and it runs ahead of demolition, not beside it. We instruct the investigator, hold the programme around the abatement window, and pick the job back up the moment clearance comes through, so the two halves are managed as one schedule rather than handed between strangers.
